By downloading, installing, or using the Chessever mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Chessever.

2. About Chessever

Chessever is the essential companion for chess enthusiasts. Our App provides a comprehensive platform for following the world of professional chess. Key features include:

• Live Tournament Coverage: Follow elite chess tournaments from around the world with real-time game updates and live move tracking.
• Player Tracking: Follow your favorite grandmasters and chess players, receive notifications when they play, and track their performance.
• Game Analysis: Review and analyze grandmaster games with integrated Stockfish engine evaluation to improve your understanding.
• Chess Calendar: Stay informed about upcoming tournaments, matches, and chess events worldwide.
• Game Database: Access a comprehensive library of chess games from major tournaments and elite players.

3. User Accounts

To access certain features, you may need to create an account. When doing so, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept full responsibility for all activities that occur under your account
• Not share your account with others or create multiple accounts

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for extended periods.

4. Premium Subscription

Chessever offers a Premium subscription that unlocks enhanced features for serious chess enthusiasts:

Premium Benefits Include:

• Countrymen & Favorites: Follow players from your country and create a personalized list of favorite players with priority notifications.
• Opponent Preparation Tools: Access comprehensive player statistics and game history to prepare for your own tournament opponents.
• Unlimited Studies: Create, save, and organize unlimited chess studies and analysis for personal improvement.
• Advanced Search & Filters: Use powerful search filters to find specific games, openings, players, and tournaments in our database.
• Full Library Access: Unlock complete access to our chess game database and library features.
• Ad-Free Experience: Enjoy the App without any advertisements.
• Priority Support: Get faster responses from our support team.

Subscription Plans:

• Monthly Subscription: Billed monthly at the price displayed in the App Store or Google Play Store at the time of purchase.
• Annual Subscription: Billed once per year at a discounted rate compared to monthly billing.

Billing Terms:

• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Billing: Your Apple ID or Google Play account will be charged within 24 hours prior to the end of the current period.
• Price Changes: Subscription prices may change. You will be notified in advance of any price changes.
• Free Trials: If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refunds are handled by Apple or Google according to their respective refund policies.

5. Ethical Use & Community Standards

Chessever is committed to fostering a positive and respectful chess community. We expect all users to uphold the spirit of fair play and sportsmanship that chess represents. You agree to:

• Respect the Chess Community: Treat fellow chess enthusiasts, players, and content with respect and dignity.
• Use Content Responsibly: Do not misuse game data, player information, or analysis tools for harassment, cheating in external games, or any malicious purpose.
• Maintain Fair Play: Do not use our analysis tools or game data to gain unfair advantages in ongoing online or over-the-board games you are participating in.
• Respect Intellectual Property: Do not redistribute, commercially exploit, or claim ownership of game data, analysis, or content provided through the App.
• Accurate Information: Do not spread misinformation about players, tournaments, or game results.

6. Prohibited Conduct

You agree NOT to:

• Use the App for any unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorized access to any part of the App, other users' accounts, or our systems
• Interfere with, disrupt, or overload the App, servers, or networks
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Use automated systems, bots, scrapers, or other tools to access the App without permission
• Circumvent, disable, or interfere with security features of the App
• Use the App to transmit malware, viruses, or other harmful code
• Collect or harvest user data without authorization
• Impersonate any person or entity, or falsely claim affiliation with any person or entity
• Use the App in any manner that could damage, disable, or impair our services
• Violate any applicable local, state, national, or international law or regulation

7. Intellectual Property Rights

The App, including its design, features, functionality, code, graphics, logos, and content created by Chessever, is owned by Chessever and protected by copyright, trademark, and other intellectual property laws.

Your License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Restrictions: You may not copy, modify, distribute, sell, lease, or create derivative works based on the App without our express written permission.

8. Third-Party Content & Data Sources

The App displays chess game data, tournament information, player statistics, and related content that may be sourced from third parties, including but not limited to:

• Official tournament organizers and chess federations
• Chess platforms and databases (e.g., Lichess)
• FIDE and national chess organizations

While we strive for accuracy and timeliness, we do not guarantee the completeness, accuracy, or reliability of third-party content. Game moves, results, and player information are provided for informational and entertainment purposes only.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHESSEVER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chessever and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.

12. Account Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe:

• Violates these Terms of Use
• Is harmful to other users, us, or third parties
• Is fraudulent, abusive, or illegal

Upon termination, your right to use the App will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We may modify these Terms at any time at our sole discretion. We will notify you of material changes by posting the updated Terms in the App and/or sending you a notification. Your continued use of the App after such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chessever operates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration or the appropriate courts in our jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chessever regarding your use of the App and supersede any prior agreements or understandings.
